So what study was this latest smoking ban based on? Well after a little searching, I found that the study cited was preformed by the Robert Wood Johnson Foundation. This is yet another case of basing law on biased studies. The RWJF, according to their own web page, among other causes, is on a mission to:

Also of interest is the RWJF is the offspring of co-founder of Johnson & Johnson, Robert Wood Johnson. RWJF is currently the largest single stockholder of Johnson & Johnson, with over 35,000,000 shares. Yes that's over 35 million shares. So, out of all the young smokers interviewed, only 12% of them had used flavored cigarettes within the last 30 days. That statistic, of course, was not used by the FDA when writing up the news release. Also of note is the missing data. In the study, they do not mention the number of people polled to gather the data. They also fail to take into account that these flavors were not available when smokers over the age of 30 began smoking. Since brand loyalty is common in adult smokers, it makes sense that less of them consume the newer flavored varieties than the younger smokers. That is just one more tell-tale sign that the science part of this study was disturbingly neglected.

The fact is cigarette companies have been unable to advertise to youth over a decade. They are not allowed to have commercials on TV, or place written ads in any publication that could even be considered attractive to youth. Children are indoctrinated, by the anti-smoking crusaders, at a very young age about how bad smoking is. The people who start smoking in this day and age have the knowledge that its unhealthy and are choosing to do so anyway. Plain and simple, they want to smoke and all the biased studies in the world are not going to stop that.

The only exception to this new flavored cigarette ban is menthol cigarettes. However, the FDA hasn't commented on why menthols were exempt from this new ban. I would make an educated guess that menthols are being left out for two reasons. First, menthol cigarettes are a huge seller for US companies as opposed to the smaller market for US produced flavored cigarettes, and the Indonesian clove varieties. Banning menthol cigarettes would have triggered a lot more fight out of the American tobacco companies. In fact, the Altria Group Inc (owners of Phillip Morris), supported the ban, which they certainly would not have done if it had included menthols. This is not surprising since they do not produce any flavored cigarettes, aside from the exempted menthol type, and may actually gain customers who, up till now, smoked imported clove cigarettes or Camel's Flavored cigarettes.

Second is the popularity of menthols. If they would have banned menthols on top of the cloves and fruit flavored specialty cigarettes, there would have been a far bigger public outcry about it. The fact that they left the most popular flavor off the ban list, shows that its not really about the teen smokers. In fact, aside from menthols, most flavored varieties of cigarettes were only sold in tobacco specialty shops which you can not legally even enter unless you are 18.

News For The Playstation Network Outage Anonymous Says They Didn't Do it This Time

If you love to play games on your PlayStation 3, you know that the PlayStation 3 suffered from a major outage on Friday. If you try to clock on and play online games, your PS3 clocks you back out, if you check to see what is wrong, the PS3 network tells you they are performing maintenance. While the outage began Friday April 22, the problems with the PlayStation 3 network have been off and on for weeks now.

Some people claimed that "Anonymous" hacked into Sony's network and shut down PS3 for the weekend. Both my nephews told me this story, so I investigated and this is what I found;"For Once We Didn't Do It--- Sony's PlayStation Network, its online service for PlayStation 3 and its PlayStation Portable consoles, suffered from a major outage today; which is on-going as of this writing. According to Sony's blog, the interruption in service may last into the long weekend - for at least another "full day or two". Sony released a statement through its EU blog, saying that the network outage may be a result of "targeted behavior by an outside party", brining in the possibility of cyber-attacks. Adding to the confusion is the fact that the message has since been removed. While it could be the case that other Anons have acted by themselves AnonOps was not related to this incident and takes no responsibility for it. A more likely explination is that Sony is taking advantage of Anonymous ' previous ill-will towards the company to distract users from the fact the outage is acutely an internal problem with the companies servers. I am not affiliated with PS3 or anonymous, I play games on the PlayStation 3 system because I enjoy online games. As a gamer, I don't believe we should suffer because of this situation. Anonymous is angry at Sony because they monitor everybody's IP address when they play games on their PS3 network. I don't like this either because it seems to be too big brother like to me. On the other hand, Sony does not charge to use their online service and they also monitor for cheaters and hackers.

Now we all know why we cannot play online games on the PlayStation 3 network and all of it leads back to Sony. Sony has either been hacked and is being held hostage by Anons working on their own or Sony's network is a complete mess because Sony is incompetent. PlayStation 3 players and fans sit here waiting for our systems to reboot. Many of us are tired of turning on the system only so see PlayStation Network is currently undergoing maintenance.

Oxides of nitrogen can have adverse effects on health, particularly among those with respiratory problems. In addition, they contribute to acidification, and to ground level ozone formation. Particulates are also damaging to health, particularly those suffering from cardiovascular and respiratory complaints.

What has been done to control these emissions?

Directive 97/68/EC was passed by the European Parliament and the Council of 16 December 1997 to approximate the laws of Member States relating to measures against the emission of gaseous and particulate pollutants from internal combustion engines to be installed in non-road mobile machinery. Several amendments have been made to this directive including, 2001/63/EC, 2002/88/EC, and 2004/26/EC to include technological advancements and to extend the scope of the directive to cover agricultural and forestry tractors, small spark ignition engines, locomotives and inland waterway vessels. The directive identifies the necessity to control emissions of air pollutants that have recognised health risks such as nitrogen dioxide, particulates black smoke and other pollutants such as carbon monoxide.

How does it work?

The directive approximates laws of the Member States with regard to emission standards and has established a ''type approval' procedure for engines intended to be fitted to NRMM. Type approval is a procedure whereby a Member State certifies that an internal combustion engine 'type' or 'family' meets the minimum technical requirements specified in the directive with regards to its level of emission of gaseous and particulate pollutants. Through certification, engine 'types' or 'families' can be approved with the assumption that, as a result of similar design, the expected exhaust emissions will comply with requirements of the directive.

What does this mean for the Construction Industry?

The Mayor of Londons 'Best Practice Guidance' already recommends minimum standards for off-road vehicles associated with increasing numbers of construction sites in London and large high profile demolition and construction sites, more commonly being asked by local planning authorities to specify exhaust emission controls for NRMM within their Construction Environmental Management plans.

In instances where the existing poor air quality exists upgrading NRMM to the latest engine 'type' or 'family', where budget allows, can not only reduce the impact construction activities have on local air quality but also have climate change benefits through efficient / clean engine technologies. As an alternative a range of exhaust after-treatment technologies is also available as a retrofit or as an original equipment option. Where upgrading to the latest technology or retrofit is not possible, other simple changes to on-site operations can be made to reduce the impact of NRMM. Such changes as using ultra low sulphur equivalent diesel and routinely maintaining/servicing an engine can hugely reduce levels of pollutants. Moreover, careful consideration of where to locate stationary construction plant equipment such as generators and cranes can also minimise the impact of exhaust emissions i.e. away from pedestrian walkways or areas where members of the public may be exposed for any length of time. A cost effective way that companies with sizeable stocks of NRMM can minimise their impacts on air quality at the most sensitive sites would be to distribute only there newest NRMM to sites with existing air quality issues.

With ever increasing pressure on the construction industry to tighten up their environmental practices, emissions from NRMM should not forgotten and through planned equipment renewal and on-site management companies can help protect the general public and employees against recognised health risks from air pollution and improve their environmental credentials.

She has been found guiltyof possession of cocaine at least two times, along with transporting narcotics and driving under the influence of drugs. Most recently, she was ordered to wear an ankle bracelet after she was reported to be under the influence of at least alcohol and missing her scheduled court appointment. The ankle bracelet will monitor and determine if Lindsay uses either alcohol or drugs which would send her to jail for violating her probation. Along with the ankle bracelet, Lindsay will be required to undergo random drug testings throughout her probation.

There is one problem with the restrictions that Lindsay has been recently subjected to and that is she can still take prescription medication that is prescribed for her by a doctor. And like everybody knows, doctors are more lenient today with prescribing drugs so she will most likely be able to get her hands on something which can be abused. Hopefully, Lindsay has finally learned her lesson and will not even try to obtain any medication while she is on her probation. But, if the past is any indicator of what the future holds for Lindsay, she will again relapse at least with alcohol and drugs.

The weeks old cholera outbreak epidemic is exposing Haitians to new risks as cholera spreads in Port Au Prince, and its environs, the epicenter of the January 2010 earthquake which killed more than 230,000 persons and rendered over two million person homeless.

The United Nations now estimates that over 200,000 could be infected and thousands killed, and that cholera could spread to the Dominican Republic, a neighbor nation of Haiti

The outbreak of cholera, dysentery, communicable diseases of epidemic or even pandemic proportions were all too predictable and even expected in the aftermath of the earthquake catastrophe. The outbreak of the current cholera epidemic is harbinger of even worse miseries which are most probable.

The spread of cholera and other diseases, are no surprises, given the present conditions in various encampments in Haiti. It is now being projected that the current cholera will kill thousands, even though cholera was officially eliminated from Haiti almost 100 years ago

Filth ,vile, polluted water are flowing into rivers, and river water remains the source of water for domestic uses for more than 60% Haitians. Two million Haitians displaced and dislocated by the January earthquake have been living in tents camps in Port Au Prince its environ. All types wastes, human feces, and garbage generated from these overcrowded camps have produced admixtures of extremely unpleasant health consequences.

The dire conditions of these two million Haitians displaced, dislocated and made homeless by the cataclysmic earthquake is now made worse by the rainstorms which has engineered a flow and mixture of sludge generated by multitudes of Haitians confined to limited landmass without social amenities or facilities. Poor public infrastructures, the absence of a sewer system have been exacerbated by the earthquake.

Even for persons not in the medical field or trained in medicine anticipated these epidemics of cholera and other diseases. We registered our concerns regarding the looming or impending health hazards in congested camps without pubic infrastructures, facilities or amenities. There are concerns that there could be outbreaks of cholera, diarrhea and other diseases which might result from the now festering poor sanitary conditions and the scarcity of clean water, electricity, as well as exposed broken sewers. All these present logistical nightmares for search and rescue personnel, local and foreign, requiring dynamic modalities. And again, building local capacities is crucial, in view of long term considerations

But it is was always foreseeable.

There is still no water, no electricity available to all regularly and on steady, or reliable basis, there are continuing concerns for disease outbreaks of epidemic proportions, such as cholera and other diseases which are exacerbated by unsanitary conditions. The congested tents camps environment in which Haitians displaced by the earthquake now live, is said to be suffused and reek with raw sewage and rain water flowing in the camp being a common sight

It is really sad that 2 million Haitian are still homeless more than 10 months after earthquake which killed 230,000 people. It is so disconcerting that our microwave culture with short attention span, have forgotten or at least, have allowed the plights and predicaments of Haitians, victims of the worst earthquake, are abandoned and their abject conditions have receded to the back burner and recesses of our consciousness.

We spend two trillion dollars tangling with real and imagined enemies in Afghanistan and Iraq, and yet, we do not have the will and courage to provide basic human needs to the two million persons still homeless in the aftermath of the disastrous earthquake in Haiti?

It will be recalled that in the aftermath of the cataclysmic earthquake in January, there were almost a sense of eagerness by and between nations to openly compete and be seen as the largest donor and the best helper of the hapless people and nation of Haiti, but, almost a year has passed and only three nations, namely, Sweden, Norway and Brazil, have followed through and keep their promised and delivered on the monies pledged to Haiti relief and reconstruction efforts.

More than ten months after of the January 12, 2010 earthquake and 2 million Haitians still live on the streets in full public view, subject to the elements, heat, the rains, mudslides and hurricanes.

2 million Haitians are still subject to disease outbreaks such as cholera, dysentery and diseases from poor living conditions, poor sanitation and impure drinking source.

During the blitzkrieg in the aftermath of the earthquake in January, more than sixty nations promised money and material aid in excess of five billion dollars, but, six more later, only Brazil, Norway and Sweden has fulfilled and redeemed their pledges; but why is this the case?

But where are the nations who made loud promises and thereby deceived all of us, while giving Haitians false hope, and now, disappointment?

Cholera was eliminated in Haiti decades before the earthquake on January 12, 2010. In the aftermath of that catastrophic earthquake however, many persons, expert and average persons, expressed the fear that unsanitary conditions in the camps or shelters where displaced and dislocated victims of the earthquake lived would soon cause epidemics, communicable diseases.

It has come to pass as predicted and predictably so, that there is now a cholera epidemic from outskirts of Port Au Prince and from the Haitian countryside, killing over 500 people and sickening almost 200,000 persons who may now be infected and would be hospitalized. There is now a growing concern that a cholera epidemic will infiltrate the estimated two million Haitian earthquake victims who are still in flimsy shelter in various camps in Port Au Prince, still displaced and dislocated 10 months after that cataclysmic earthquake

The United Nations is currently investigating the origin and source of the cholera outbreak in Haiti. Accusing fingers are currently being directed at UN Peacekeeping forces said to have had exposed septic system in close proximity to River Meille near the city of Mirebalais the epicenter and origin of the cholera outbreak which is now spreading north and to major cities, camp shelters, where it could wreak havoc in view of the population density and scarcity of clean water.

Where is the international community? And where is God? As expected there is cholera outbreak epidemic in Haiti and as equally expected, the epidemic is spreading Where is the so-called international community and goodwill? Where indeed is everybody? The UN says 200,000 could be infected and thousands killed, and cholera could spread to the Dominican republican neighbor nation of Haiti

Cholera in Nigeria, in Pakistan, and now, in the beleaguered nation of Haiti. Cholera is a tad too simple to prevent through the provision of clean water and good sanitation, sanitary systems. And the antidote to cholera is similarly simple to manage where the resources are available, such as salt and sugar solutions used in Oral Re-hydration Therapy or ORT to prevent dehydration or in worst cases, antibiotic treatment therapies are employed to address acute cases, and yet, in all the cited cases in Nigeria, Pakistan and Haiti this years, thousands are already dead! In a world of plenty and so much abundance?

Clove and Flavored Cigarettes Banned in the USA: The Next Victim on the War on Smokers

As of September 21st 2009 all flavored cigarettes including fruit, candy and clove flavored cigarettes have been banned in the United States of America. The ban itself came from the FDA, which was authorized to do so by the Family Smoking Prevention and Tobacco Control Act signed into law by President Obama back in June. According to an FDA news release, this was done in order to curb youth smoking. Using the standard Its for the Children clich the FDA stated:

"Almost 90 percent of adult smokers start smoking as teenagers. These flavored cigarettes are a gateway for many children and young adults to become regular smokers," said FDA Commissioner Margaret A. Hamburg, M.D. "The FDA will utilize regulatory authority to reduce the burden of illness and death caused by tobacco products to enhance our Nation's public health."

The FDA further claims:

Flavors make cigarettes and other tobacco products more appealing to youth. Studies have shown that 17 year old smokers are three times as likely to use flavored cigarettes as smokers over the age of 25.(1)

So what study was this latest smoking ban based on? Well after a little searching, I found that the study cited was preformed by the Robert Wood Johnson Foundation. This is yet another case of basing law on biased studies. The RWJF, according to their own web page, among other causes, is on a mission to:

Ensuring that our research triggered policy changes that curb tobacco use by developing an advocacy infrastructure that prompted public policy including increased taxes on tobacco products, smoke-free cities and states, and increased access to treatment for tobacco dependence. (2)

Also of interest is the RWJF is the offspring of co-founder of Johnson & Johnson, Robert Wood Johnson. RWJF is currently the largest single stockholder of Johnson & Johnson, with over 35,000,000 shares. Yes that's over 35 million shares. J&J also just so happens to be the distributors of Nicoderm, Nicorette, and a few other stop smoking aids. J&J currently has the largest stake in the quitting smoking racket with annual profits well into the hundreds of millions of dollars. RWJF is putting out studies with the intent to make smoking more difficult and expensive, then are profiting on sales of these drugs designed to aid in those trying to quit smoking.

Does this sound like a group capable of conducting unbiased scientific tobacco research to you? So what exactly did they do to determine that flavored cigarettes are causing America's youth to start smoking? Well, it turns out their so called study was nothing more than a phone poll.

Here is where it gets really interesting. According to their own study,

Of the smokers in the NYSCS (National Youth Smoking Cessation Survey) (age range from 1726 years), 11.9 percent reported flavored cigarette use in the past 30 days. Among the AHCSS (Assessing Hardcore Smoking Survey) sample (age 25 and older), 6.7 percent of smokers reported flavored cigarette use. (2)

So, out of all the young smokers interviewed, only 12% of them had used flavored cigarettes within the last 30 days. That statistic, of course, was not used by the FDA when writing up the news release. Also of note is the missing data. In the study, they do not mention the number of people polled to gather the data. They also fail to take into account that these flavors were not available when smokers over the age of 30 began smoking. Since brand loyalty is common in adult smokers, it makes sense that less of them consume the newer flavored varieties than the younger smokers. That is just one more tell-tale sign that the science part of this study was disturbingly neglected.

The fact is cigarette companies have been unable to advertise to youth over a decade. They are not allowed to have commercials on TV, or place written ads in any publication that could even be considered attractive to youth. Children are indoctrinated, by the anti-smoking crusaders, at a very young age about how bad smoking is. The people who start smoking in this day and age have the knowledge that its unhealthy and are choosing to do so anyway. Plain and simple, they want to smoke and all the biased studies in the world are not going to stop that.

The only exception to this new flavored cigarette ban is menthol cigarettes. However, the FDA hasn't commented on why menthols were exempt from this new ban. I would make an educated guess that menthols are being left out for two reasons. First, menthol cigarettes are a huge seller for US companies as opposed to the smaller market for US produced flavored cigarettes, and the Indonesian clove varieties. Banning menthol cigarettes would have triggered a lot more fight out of the American tobacco companies. In fact, the Altria Group Inc (owners of Phillip Morris), supported the ban, which they certainly would not have done if it had included menthols. This is not surprising since they do not produce any flavored cigarettes, aside from the exempted menthol type, and may actually gain customers who, up till now, smoked imported clove cigarettes or Camel's Flavored cigarettes.

Second is the popularity of menthols. If they would have banned menthols on top of the cloves and fruit flavored specialty cigarettes, there would have been a far bigger public outcry about it. The fact that they left the most popular flavor off the ban list, shows that its not really about the teen smokers. In fact, aside from menthols, most flavored varieties of cigarettes were only sold in tobacco specialty shops which you can not legally even enter unless you are 18.

Don't worry menthol fans, you will get your chance to have your freedom stepped on as well. The same news release states that they are examining options for regulating both menthol cigarette products, and flavored tobacco products other than cigarettes. (1) So they will get to you, its all about the baby steps.

The WTO (World Trade Organization) may force the issue sooner rather than later. Indonesian companies have already filed a complaint calling the law protective of US companies. Banning clove flavored cigarettes but not menthol flavored products could be considered a discriminatory trade practice which would lead to the WTO getting involved. This could force the US to either exempt cloves from the ban, just like menthols already are, or ban both type of cigarette.

Although non smokers are not directly effected and may even initially support this legislation I would suggest you think of the future implications of this type of law. After they have finished with tobacco, do you think its going to stop there?

Heart disease is the number one killer in the United States. Its not a far stretch that we will see them turn their swords on the unhealthy food markets next. In fact, the WHO (World Health Organization) has already proposed that countries begin taxing junk food. (3) If you know your history, this is exactly how they started fighting Big Tobacco. Still skeptical, well the same group that did the flavored tobacco study is already doing research pertaining to taxation of sugary beverages and how that would effect youth obesity. Included are sodas, sports drinks, sweetened tea, fruit drinks and punches, and other sweetened beverages. (4) Does that sound familiar? If they are banning tobacco products now, is it really that outlandish to think they will ban the foods they consider unhealthy somewhere down the line?

As Americans we have taken our freedom for granted. The second we started allowing the government to make laws based on the its for your own good principle we started down a slippery slope with no bottom in sight. Tax codes and laws are written to guide consumers along the road they want us to travel. Once enough people are following along like good little sheep, outright bans are instated. If we continue to allow these zealots to regulate our freedoms away it will not be long till we have no choices left to make at all. The question we really should be asking is, whats next?

The only exception to this new flavored cigarette ban is menthol cigarettes. However, the FDA hasn't commented on why menthols were exempt from this new ban. I would make an educated guess that menthols are being left out for two reasons. First, menthol cigarettes are a huge seller for US companies as opposed to the smaller market for US produced flavored cigarettes, and the Indonesian clove varieties. Banning menthol cigarettes would have triggered a lot more fight out of the American tobacco companies. In fact, the Altria Group Inc (owners of Phillip Morris), supported the ban, which they certainly would not have done if it had included menthols. This is not surprising since they do not produce any flavored cigarettes, aside from the exempted menthol type, and may actually gain customers who, up till now, smoked imported clove cigarettes or Camel's Flavored cigarettes.

Second is the popularity of menthols. If they would have banned menthols on top of the cloves and fruit flavored specialty cigarettes, there would have been a far bigger public outcry about it. The fact that they left the most popular flavor off the ban list, shows that its not really about the teen smokers. In fact, aside from menthols, most flavored varieties of cigarettes were only sold in tobacco specialty shops which you can not legally even enter unless you are 18.

Don't worry menthol fans, you will get your chance to have your freedom stepped on as well. The same news release states that they are examining options for regulating both menthol cigarette products, and flavored tobacco products other than cigarettes. (1) So they will get to you, its all about the baby steps.

The WTO (World Trade Organization) may force the issue sooner rather than later. Indonesian companies have already filed a complaint calling the law protective of US companies. Banning clove flavored cigarettes but not menthol flavored products could be considered a discriminatory trade practice which would lead to the WTO getting involved. This could force the US to either exempt cloves from the ban, just like menthols already are, or ban both type of cigarette.

Although non smokers are not directly effected and may even initially support this legislation I would suggest you think of the future implications of this type of law. After they have finished with tobacco, do you think its going to stop there?

Heart disease is the number one killer in the United States. Its not a far stretch that we will see them turn their swords on the unhealthy food markets next. In fact, the WHO (World Health Organization) has already proposed that countries begin taxing junk food. (3) If you know your history, this is exactly how they started fighting Big Tobacco. Still skeptical, well the same group that did the flavored tobacco study is already doing research pertaining to taxation of sugary beverages and how that would effect youth obesity. Included are sodas, sports drinks, sweetened tea, fruit drinks and punches, and other sweetened beverages. (4) Does that sound familiar? If they are banning tobacco products now, is it really that outlandish to think they will ban the foods they consider unhealthy somewhere down the line?

As Americans we have taken our freedom for granted. The second we started allowing the government to make laws based on the its for your own good principle we started down a slippery slope with no bottom in sight. Tax codes and laws are written to guide consumers along the road they want us to travel. Once enough people are following along like good little sheep, outright bans are instated. If we continue to allow these zealots to regulate our freedoms away it will not be long till we have no choices left to make at all. The question we really should be asking is, whats next?
